Terms & Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. The promotion is open to all residents of Australia aged 16 years and over. Offer excludes New Zealand. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
2. Promotion commences April 30, 2009 and closes 10.00am May 31, 2009. The promotion will be judged by a panel of judges appointed by the Promoter. The judging will take place at 54 Park Street, Sydney NSW 2000 and will begin on May 19, 2009. Judges’ decision is final and no correspondence will be entered into. The winners will be contacted by phone and mail using the contact details provided in their entry. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit.
3. To enter, individuals must visit www.cleo.com.au, follow the prompts to the competition entry page, input the requested details including their full name, valid email address and current mailing address and an answer to: “Tell us in 25 words or less why you’d like to win your very own pink guitar!”.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete or indecipherable entries will be deemed invalid.
6. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
7. The best valid entry, as determined by the judges, will receive a major prize pack consisting of one pink Epiphone “Les Paul Standard”, limited edition electric guitar from Gibson valued at $1599.00 and a Universal Music CD pack from Universal Music Australia valued at $1000. Total major prize valued at $2599.
The next best 20 valid entries, as determined by the judges, will each receive a signed copy of ‘Look It Up’ CD, by Jasmine Rae provided by Universal Music Australia valued at $30 each. Total minor prize pool valued at $600.
8. Total prize pool valued at $3199. Prizes, or any unused portion of the major prize, are not transferable, exchangeable or redeemable for cash.
9. In the event that any prize is unavailable; the Promoter reserves the right to substitute that prize with a prize to the equal or greater value and/or specification.
10. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or to modify, suspend, terminate or cancel the promotion, as appropriate.
11. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and/or (f) use of a prize.
12. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
13. By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
14. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition are governed by the Privacy Notice.
